CONCERNING
PLANT PROPAGATING MATERIAL OF FOREST PLANT

THE MINISTER OF FORESTRY,

Considering :

a. that in the framework of increasing the productivity of forest stands and the quality of forest products, plant propagating material of forest plant has a very decisive role;
b. that at present plant propagating material of forest plant as far as quality and quantity are concerned cannot meet the need for plant propagating material as expected;
c. that in connection with the above mentioned fact it is deemed necessary to lay down Decree of the Minister of Forestry concerning Plant Propagating Material of Forest Plant.

In view of :

3. Decree of the President of the Republic of Indonesia No. 72/1971;
4. Decree of the President of the Republic of Indonesia No. 44/1974;
5. Decree of the President of the Republic of Indonesia No. 43/1978;
6. Decree of the President of the Republic of Indonesia No. 15/1984 connected with Decree of the President of the Republic of Indonesia No. 47/1988;
7. Decree of the President of the Republic of Indonesia No. 64/M/1988;
8. Decree of the Minister of Forestry No. 116/Kpts-II/1989.

DECREE OF THE MINISTER OF FORESTRY CONCERNING PLANT PROPAGATING MATERIAL OF FOREST PLANT.

Article 1

For the purposes of this Decree :

1. "Forest Tree Seed of the plant" is a plant material for breeding in the form of plant parts as well as seeds;
2. "The source of seed plants" means an area within the district or non- forest forest district contains a natural forest as well as forest plantations, where stands plant can produce seeds of forest plants are found;
3. "Stand from seed plant" means a forest stand which is found in a natural forest or plantation forests as a producer or plant seeds for a certain period;
4. "Garden Maintenance" means an area created specifically to produce high -quality seeds of forest plants;
5. "The label of the seed plant" means an information written, printed, pictorial about the quality and origin of propagatin plant materials, which are listed or printed clearly on the number of plant seeds in bulk form or a package.
6. "Certificate of seed plant" means a way to issue certificates for multiplication, production and distribution of plant seeds in accordance with rules established by the Minister of Forestry.

Article 2

The designation and registration of stand of plant propagating material shall be carried out by the Director General of Reforestation and Soil Rehabilitation on the suggestion of the Head of the Regional Office of the Ministry of Forestry.

Article 3

(1) A nursery-garden my be laid out especially as source of plant propagating material for the need of superior quality plant propagating material of forest plant.

(2) A nursery-garden may be laid out in a forest district or non-forest district.

Article 4

The procurement and distribution of plant propagating material may be undertaken by a company that has come up to the requirements and has been appointed by the Director General of Reforestation and Soil Rehabilitation.

Article 5

(1) Any plant propagating material to be distributed shall meet the quality standard set by the Director General of Reforestation and Soil Rehabilitation.

(2) Any plant propagating material to be distributed shall be affixed to it a label approved by the plant propagating material examiner.

(3) For plant propagating material that has been examined, a certificate of quality may be issued if so required.

(4) Procedures for the examination and certification of plant propagating material shall be set out by the Director General of Reforestation and Soil Rehabilitation.

Article 6

(1) The importation into and exportation from the territory of the Republic of Indonesia of plant propagating material of forest plant shall subject to prior approval from the Minister of Forestry.

(2) The importation into and exportation from the territory of the Republic of Indonesia of plant propagating material of forest plant shall be subjected to plant quarantine regulations.

Article 7

The Regional Forestry Services shall conduct supervision of plant propagating material of forest plant under co-ordination of the Provincial Regional Office of the Ministry of Forestry.

Article 8

By the issuance of this Decree the on-going activities connected with the plant propagating material of forest plant shall be brought into line with the provisions of this Decree.

Article 9

This Decree shall take effect on the date of issuance.
